This program will cover recent developments in ethical issues that arise for arbitrators in commercial arbitration. The panel will address several useful topics, some of them novel, including (1) recent case law concerning disclosures, (2) best practices with conflicts checks, including the use of “blanket” disclosures and social media, (3) offering references on other arbitrators and listing counsel and other arbitrators as references; and (4) dealing with misconduct by parties and colleagues. Three experienced arbitrators — Hon. Myra Selby, Edna Sussman and Richard Ziegler — will explore these issues in an interactive dialogue and audience polling. The program will be moderated by CCA Associate Jiyun Lee.
