AI — not “what is it” and “how does it work” but:
- Do you use it at all? For what? Which platform?
- Do you include reference to AI in your standard initial scheduling order?
- Do you care about disclosure of use by counsel? By the arbitrator?
- Is confidentiality of case information a concern with some platforms?
Anything else on your mind — e.g.,
- Are discovery demands becoming more prevalent?
- Do you urge settlement?
- Any trends you see developing in arbitration? (Apropos that, attached is a short Bloomberg piece on litigation trends from the GC perspective. One interesting line in the report: “Arbitration was the only dispute type to notch growth, with 49% of organizations involved in at least one arbitration, up from 38% in 2024.”)
