Richard Mainland

Richard Mainland has built a career as a business trial lawyer, arbitrator and mediator. He now focuses his practice solely on service as an ADR neutral. He is committed to achieving the benefits of ADR -- speed, informality, fairness, cost-efficiency and the ability of parties to design their own processes.

Experience

Richard has served as a neutral arbitrator in over 250 arbitrations over the past 25 years, with an emphasis on complex commercial cases. He is a member of the American Arbitration Association’s Large Complex Case Panel, as well as the AAA’s Employment, Entertainment, Mergers and Acquisitions and Class Arbitration panels. He also serves on the AAA’s Panel of Mediators. Cases

Richard’s arbitration experience has included: -- claim by major talent agency against producer of reality television shows; -- corporation’s claims for determination of purchase price under a mergers agreement; -- claim by investment advisory firm for trade secret misappropriation and unfair competition against former executive; -- dispute between international joint venture partners concerning development of solar energy facility; -- claim for $75 million damages arising out of agreement for sale of medical devices; -- claim by major law firm for recovery of legal fees, with counterclaims for legal malpractices seeking $70 million in damages.

Training

Richard regularly attends arbitration training provided by the American Arbitration Association, including courses on preparation of arbitration awards (2017) dispositive motions in arbitration (2016), disclosure, vacatur, sanctions and arbitrator authority (2014); and challenges at the preliminary hearing (2011). Richard’s mediation training includes ’Mediating the Litigated Case,’ a five-day course on mediation at the Strauss Institute, Pepperdine Law School. Richard also lectures regularly on arbitration topics, including serving on the faculty at the USC-JAMS Arbitration Institute (2016), ’Mastering Commercial Arbitration -- for Lawyers and Arbitrators,’ Los Angeles County Bar Association (2016): ’The Managerial Arbitrator,’ College of Commercial Arbitrators (2015).
